KnowYourMarket.ai provides marketing intelligence tools, reports and related services for businesses. References to KnowYourMarket.ai, KYM, we, us or our mean the business operating the Website and Services. You can contact us at [email protected].
1. Scope
These Terms and Conditions govern your access to and use of our website located at knowyourmarket.ai and any related pages, tools, reports, demos, files and services we make available, including paid reports such as The Growth Map and any AI powered outputs. By accessing or using the Website or purchasing a Service, you agree to these Terms.
2. Eligibility and Accounts
You must be at least 18 years old to purchase. If you create an account, you are responsible for keeping your credentials secure and for all activity under your account.
3. Orders, Pricing and Payment
- Prices are shown in the currency stated at checkout or point of purchase and are subject to change without notice.
- Payments are processed securely by third-party payment providers such as Stripe. By placing an order, you authorise the applicable provider to charge your selected payment method for the total amount shown, including any applicable taxes or fees.
- You must provide accurate billing information. If a payment fails, we may suspend delivery until payment is successful.
4. Deliverables and Timelines
- Many Services are digital in nature. Delivery occurs either immediately after checkout or within the timeframe stated on the Website or in your order confirmation.
- For scoped reports such as The Growth Map, delivery windows are estimates. We will act reasonably to meet stated timelines.
5. Refunds and Australian Consumer Law
- Because our deliverables are digital and often customised, all sales are final unless required by the Australian Consumer Law.

- We own all intellectual property rights in the Website, the KYM platform, our frameworks, templates, models and pre-existing materials.
- Upon full payment, we grant you a non-exclusive, non-transferable licence to use the specific deliverables supplied to you for your internal business purposes. You must not resell, sublicense or publicly distribute our deliverables without written consent.
8. AI Generated Outputs and Reliance
- Our Services may generate insights or content using artificial intelligence. AI outputs can contain errors or reflect limitations of source data and third-party systems.
- Outputs are provided for general information to assist decision-making. They do not constitute professional advice. You should validate critical outputs and exercise your own judgement.
9. Third-Party Services and Links
We may integrate or link to third-party services such as Stripe, Google, Meta and others. We are not responsible for third-party content, performance or terms. Your use of third-party services is governed by their terms and policies.
10. Confidentiality
If either party discloses confidential information, the receiving party must keep it confidential and use it only to perform or receive the Services, except where disclosure is required by law.

12. Warranties and Disclaimers
- Except for any non-excludable guarantees under the Australian Consumer Law, the Website and Services are provided on an as-is and as-available basis without warranties of any kind.

13. Limitation of Liability
